Welcome to bCard ("we," "our," or "us"). By using our mobile application ("App"), you ("User") agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read them carefully.
1. Acceptance of Terms
By downloading, accessing, or using our App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
bCard's primary objective is to create a digital business card that is always available on your phone and can be easily shared via QR code or through a link using any messenger or other methods. Users can populate their business card with various details and share it with others at their discretion.
3. User Obligations
3.1 Accuracy of Information
You agree to provide accurate, current, and complete information during registration and while using the App. You are responsible for maintaining the accuracy and completeness of this information.
3.2 Use of QR Codes and Links
You are solely responsible for how you use and share the QR codes and links generated by the App. Sharing your contact details via our App is entirely at your own risk and responsibility. We are not responsible for whom you choose to share your data with or how they use it.
3.3 Compliance
You agree to comply with all applicable laws, regulations, and Apple App Store guidelines while using the App.
4. Privacy
4.1 Data Collection
We collect the following information:
- During Registration: Email and password.
- During Use: Name, surname, email, phone number, company name, job title (if provided by you).
- Optional: Address, LinkedIn profile, Facebook profile, Instagram, custom links, and custom notes (if provided by you).
4.2 Use of Information
Your information is used to create and maintain your digital business card and enable sharing via QR code, direct link, or through messengers.
4.3 Data Sharing
We do not sell or share your personal information with third parties, except as required to provide the services or as required by law.
4.4 Security
We implement reasonable security measures to protect your information. However, we cannot guarantee absolute security, and you provide your information at your own risk.
5. Subscriptions and Payments
5.1 Free and Paid Features
The App may offer both free and premium features. Premium features may be available through a subscription plan or one-time purchase.
5.2 Billing
If you choose a paid plan, you agree to pay all fees or charges associated with the plan in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. All payments are processed through Apple’s in-app purchase system.
5.3 Cancellation and Refunds
You may cancel a subscription at any time through your Apple account settings. Refunds are governed by Apple’s refund policy.
6. User-Generated Content
6.1 Content Ownership
You retain ownership of any content you create or provide while using the App. By submitting content, you grant bCard a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with providing the service.
6.2 Prohibited Content
You agree not to submit any content that is illegal, harmful, offensive, or infringes on any third party's rights.
7. Intellectual Property
7.1 Ownership
By completing your registration with the Service or using any other components of the Service, you accept that the Service is the owner of the entire contents of the App. The use of the App may not be seen as the transfer of any intellectual property rights to the User in relation to the contents of the App.
7.2 Restrictions
Nobody shall have the right to copy, distribute, publicly display, or create derivative works based on the App, or use any materials possessed by bCard without proper authorization.
7.3 Compliance
By using the services provided by bCard or any other materials possessed by bCard, you agree to adhere to all the additional instructions on protection of copyright and trademarks that are present in the App, as well as all the other instructions and limitations.
8. Limitation of Liability
8.1 Use at Your Own Risk
Your use of the App is at your sole risk. We provide the App "as is" without warranties of any kind, either express or implied.
8.2 No Liability for Damages
bCard shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other Users of the App, us, or third parties, or for any other reason.
10. Failures in the Operation of the Service
10.1 Service Interruptions
The Service acknowledges that there may be failures in its operation resulting from technical problems or third parties' malicious acts. If such a situation arises, the Service reserves the right to suspend its work until the threats or errors have been eliminated.
10.2 Resolution
The Service undertakes to eliminate the occurring technical problems in the shortest time possible.
11. Transfer of Rights and Obligations
11.1 Service's Rights
The Service reserves the right to transfer its rights and obligations under this Agreement, in full or in part, to any physical or legal person.
11.2 Client's Rights
The Client must not break the conditions of this Agreement, or transfer its rights and obligations to third parties unilaterally without prior written permission from an official representative of the Service.
12. Violation of the Client Agreement
The Service reserves the right to suspend or terminate any Client’s access to the services provided by the Service on a unilateral basis if the Client is in breach of the terms and conditions of this Agreement.
13. Advertising Campaigns / Marketing
According to the terms and conditions of this Agreement, the Client grants the Service an irrevocable right to use and publish data about the Client possessed by it (personal, statistical data, etc.) for promotional and marketing purposes, as well as for any types of publications.
14. Electronic Mailing Policy
14.1 Mailing Types
The Service distributes several types of e-mail letters:
- Information about updates to the App.
- Notifications about new features and services.
- Promotional actions and offers.
- Other service-related communications.
14.2 Consent
By accepting the terms and conditions of this Agreement, the Client confirms their consent to receiving these e-mail letters. In each letter, the Client shall be provided with the opportunity to “Opt out of the electronic mailing list.”
15. Duration of this Agreement and Dispute Settlement
15.1 Agreement Term
This Agreement is deemed concluded at the moment of the User’s registration on the App and shall remain in force until the Client’s account is deleted.
15.2 Legal Compliance
This Agreement and the Service’s cooperation with the Clients must act within the limits of the applicable law.
15.3 Dispute Resolution
Any disputes and disagreements arising within the duration of this Agreement shall be settled by way of negotiations between the Service and the Client.
15.4 Arbitration
Disputes and disagreements related to this Agreement, which have not been settled by mutual agreement, shall be resolved by arbitration in accordance with the legislation applicable to the relations between the Client and the Service.
15.5 Agreement Availability
We do not store each particular Agreement concluded with our Clients. You can view it on the App.
16. Apple Requirements
16.1 Compliance with Apple Guidelines
You agree to use the App in accordance with Apple's App Store Review Guidelines. Any refunds will be handled by Apple according to their policies.
16.2 In-App Purchases
All in-app purchases are processed through Apple’s in-app purchase system, and you agree to the terms of sale as provided by Apple.
16.3 iOS Device Compatibility
The App may be updated periodically to remain compatible with the latest iOS versions. We do not guarantee support for outdated iOS versions or devices.
17. Standard End User License Agreement (EULA)
17.1 EULA Compliance
This App follows the Standard Apple End User License Agreement (EULA). By using the App, you agree to comply with the EULA. The EULA is available at: Apple Standard EULA.
18. Premium Subscription
18.1 Subscription Details
The cost and type of subscription are available in the App. Subscription gives you access to premium features such as push notifications, disabling ads, and additional functionalities. The payment will be debited from your Apple Store account after the subscription is confirmed.
18.2 Free Trial
Some subscriptions include a free trial period. If the subscription is not canceled within 24 hours prior to its expiration, it will be renewed automatically at the end of each period (weekly, monthly, biannually, annually, or otherwise) until you cancel.
18.3 Managing Subscription
To manage the subscription after its execution, go to your Apple Store account settings.
